Philip Kinisu  Membership

He is a member of Board of Directors at Barclays Bank of Kenya Limited.

Honorary Treasurer at the University of Nairobi.

Philip Kinisu Resignation as the EACC Chairman

Kinisu was accused of receiving lucrative tenders amounting to millions of shillings from the National Youth Service. The said company – Esaki Limited – received Ifmis payments as late as June 16. The company listed as number 154039 was dissolved on May 7, 2014, according to Kenya Gazette notice number 3337 published on May 16 that year.

A lawyer by the name Albert Ondieki petitioned Kinisu for  links to a Esaki Limited company named in the Sh791 million NYS cash theft probe. Speaker Justin Muturi mandated a National Assembly committee to probe EACC boss Philip Kinisu over links to NYS cash theft.

The Justice and Legal Affairs committee, chaired by Ainabkoi MP Samuel Chepkonga, was tasked with confirming the veracity of the evidence cited by the petitioner. The lawyer wants the EACC chairman investigated for failing to disclose this during his grilling for the position. The petitioner further said Kinisu’s continued stay in office will hamper investigations on cases touching on the NYS scam.

Ondieki wants Parliament to “recommend to the President to suspend the EACC chair pending the formation of the tribunal to investigate the said allegations and determinations thereof”.

Exciting Articles

The petitioner said the EACC was in limbo after commissioners issued a statement urging Kinisu to step aside to pave way for investigations.

Kinisu was was interrogated by DCI detectives over the graft but denied any involvement. He stood his ground after being pressured to resign saying his company won and lost tenders much like any other.Esaki received Sh246,011,720 between March 2, 2015 and June 16, 2016 from the Devolution ministry.

The Ifmis report stated the company received Sh5,890,000 from the Devolution ministry on March 2, 2015 through payment number 10001464.

On September 21, 2015, th company received Sh150,123,120 from the ministry, payment number 10002296.

Esaki further received another Sh89,998,600 million, payment number 29831 dated June 16.

Through his lawyer Wanyonyi Chebukati, Kinisu confirmed that the company received Sh35.4 million from the NYS over the past three-and-a-half years.

Further revelations, which he has failed to confirm, show Esaki was licensed to deal with pest control products on March 23 last year, just a day before the Health ministry opened a tender for the supply of insecticides and was awarded the contract of Sh150 million.

In the petition, the lawyer states Kinisu did not satisfy the provisions of chapter six of the constitution.

“He ought not have been appointed if the allegations surfacing now were available to the appointing authority. They touch on his personal integrity, competence and suitability for the position,” Ondieki said.

The House ruled that a petition had sufficient evidence to have him removed from office. The National Assembly Justice and Legal Affairs Committee found that Mr Kinisu had failed to disclose his interest in a company that did business with the scandal-ridden National Youth Service (NYS).

The committee proposed that President Uhuru Kenyatta a tribunal to investigate him. He tendered his letter of resignation the president so as to pave way for investigation thou he maintained that he and his family’s company were innocent.

Rebecca Nabutola Biography

Rebecca Nabutola was born on 17th January 1959. She is the former permanent secretary of Kenya’s Ministry of Tourism and Wildlife. She was convicted in 2012 over graft allegations.

Rebecca Nabutola Education Background

Undergraduate student at the University of Nairobi,Bachelor of arts.

Student at the Institute of Social Studies, Hague, diploma in International Relations and Development.

In 2012 together with Achieng Ong’ong’a they were convicted of conspiracy to defraud the ministry Shs.8.4 million.

Rebecca Nabutola Convicted over graft

The two were to pay for a trip that was organised for permanent secretaries to familialize themselves with the marketing of wild beast migration in Maasai Mara in June 2007. The trip was budgetted for Ksh 900,000 which was to be funded by stakeholders in the tourism sectorFormer Tourism permanent secretary Rebecca Nabutola and Kenya Tourism Board (KTB) ex-managing director Achieng Ong’ong’a have been convicted of conspiracy to defraud the ministry of Sh8.4 million.

The two will pay the price of a trip that was organised for permanent secretaries to familiarise themselves with the marketing of wildebeest migration in Maasai Mara in June 2007, a function also attended by President Mwai Kibaki.

Senior principal magistrate Lucy Nyambura on Monday ruled that the money requested by KTB from the Treasury was for marketing and asked how KTB ended up paying Sh8.4 million for a trip budgeted to cost Sh900,000, and which was to be funded by stakeholders in the tourism sector.

“The cost of the entire trip was Sh1.8 million which was to be sourced from stakeholders. No documents are there to show the other payments even after one stakeholder paid Sh500,000 for the trip.

“In fact the other accused (Duncan Muriuki) opened a fixed deposit account for the money and withdrew it soon after the trip was over,” said Ms Nyambura. The magistrate jailed Nabutola for four years while Ong’ong’a will serve three years.

The jail terms could increase to six and five years, respectively, if they fail to pay a fine of Sh1 million and Sh1.5 million, respectively.

Their co-accused Duncan Muriuki, the managing director of Maniago Safaris and a former board member of KTB, got seven years in jail and a mandatory repayment of Sh18.6 million to the Tourism ministry.

Ms Nyambura ruled that the prosecution had proved beyond doubt that the three had jointly conspired to defraud the ministry of the funds despite being public officers entrusted with the management of public funds.

“In convicting them, I have considered that they were public officers entrusted with public funds but they breached that trust put on them by their offices,” said Nyambura.

Nabutola and Ong’ong’a join former Home Affairs permanent secretary Sylvester Mwaliko in a group of ex-government officials convicted of economic crimes committed during their tenure in office.

Mwaliko was last week handed a non-custodial sentence and fined Sh3 million for abuse of office over the Anglo-Leasing scandal.

Nabutola, Ong’ong’a and Muriuki were charged with a total of 11 counts of conspiracy to defraud, failure to adhere to rules governing procurement and abuse of office.

They were all found guilty of the first count of conspiracy to defraud KTB of Sh8.4 million to fund the permanent secretaries’ trip and will each serve three years in jail.

On the second count, Nabutola and Muriuki were charged with conspiracy to defraud the ministry of Sh400,000.

Found guilty

The magistrate ruled that it was evident Muriuki’s company received the money from the ministry even though the trip was funded by stakeholders and sentenced each to one year imprisonment.

Nabutola was also convicted of wilful failure to comply with public procurement rules and abuse of office and fined Sh1 million or serve additional two years in jail in default.

“Nabutola improperly conferred a benefit to Maniago Safaris without following procedures and abused her office as the chief accounting officer,” ruled Ms Nyambura.

Ong’ong’a was found guilty of two other charges of paying money for services not rendered and for failing to comply with procurement rules.

Ms Nyambura ruled that he failed to offer any explanation why the budgeted money increased from Sh1.8 million to Sh8.9 million and why he single-handedly gave the nod for the money to be paid to Maniago Safaris even though the company was not approved by the Tourism Board.

Muriuki will serve the additional three years for conspiring to defraud the ministry as well as refund Sh18.6 million, which is double the amount his company received from the tourism ministry.

Rebecca Nabutola Release from Jail

The High Court has ordered the release of former Tourism Permanent Secretary Rebecca Nabutola and Kenya Tourism Board ex-MD Achie’ng Ong’onga who had been jailed for fraud on September, 2012. The two who had been behind bars since September 10, were released on a Sh500,000 cash bail or bond of Sh1 million pending the appeal of their four year jail sentence.

Justice Msagha Mbogoli, who ordered the release, said the appeal has chances of success. The tourism officials had in September been charged in court over the irregular payment of Sh8.9 million to a tour company and abuse of office, which they denied and released on bail. Nabutola was sentenced to four years in prison and fined Sh1 million for abuse of office and failure to comply with procurement laws. Dr Ong’ong’a was sentenced to three years in jail and fined Sh500,000 for abuse of office and another Sh1 million for fraud. Last week the duo had asked the court to set them free citing that they were not informed by the trial magistrate during the hearing of the case that they were entitled to exercise their right to recall witnesses.

As a law student he interned at Mereka and company which specialized in insurance Law. Thereafter, he joined Hamilton Harrison and Matthews, one of the oldest law firms with a strong commercial civil litigation practice.

In 1986 he took a position as State Counsel in the Public Prosecutions Department, where he was posted to the Kisumu Provincial State Counsel Office. As a criminal prosecutor, he was responsibe for advising and directing the criminal investigators on the adequacy or direction of their investigations to ensure successful prosecutions.

In 1992 he was transferred to Nairobi.

In 1992 Murgor resigned from the civil service and joined his wife in private practice at Murgor and Murgor Advocates.[6] He was appointed to the legal team that defended President Daniel arap Moi in election petitions filed after the first multiparty general elections in 1992.

In 2007, he took over as the Managing Partner at Murgor and Murgor Advocates.

In 2008, he represented the Central Bank in the Grand Regency Scandal on the sale of the grande Regency Hotel.

Murgor has since handled several landmark cases touching on the enforcement of fundamental rights under the new constitution relating to gender rights. Recently, he sued the directors and shareholders of Imperial Bank Limited on behalf of the Kenya Deposit Insurance Corporation to recover KShs.45 Billion of customer deposits lost due their negligence and breach of fiduciary duties.

Thereafter, he was denied his legal fees in an attempt to force him to compromise the cases. He was eventually forced to quit the cases in 1998, rather than succumb to the threats.

When Mwai Kibaki became President in 2003 on an anti-corruption platform, the president immediately re-appointed him to the Goldenberg scandal cases, and a month later he was appointed as the Public Prosecutor, a post he reluctantly accepted on condition that he would be granted a free hand in reforming the failed public prosecution services, and prosecution perpetrators of grand corruption.

Murgor faced resistance in relation to the prosecution of Anglo-Leasing Scandal and a thorough investigation into a case involving the trafficking of 1.2 tonnes of cocaine worth KShs 6.4 billion. The cases were thwarted by Presidential insiders. The correlation between the prosecution and threats to his person was heightened when his home was attacked. He was terminated as Public Prosecutor in May 2005.

This was during a meeting when the UDM chair Major General (Rtd) John Cheruiyot unveilled the new party headquaters on 4th Ngong Avenue and announced the National Executive Committee had endorsed Mr. Mugor for the top seat but will subject his candidature to the National Delegates Conference for Ractification as per party constitution

In the 1990’s she purchased a salon in Nairobi and it was a ‘side business’ since she was working at a bank. She borrowed Kshs. 800000 to purchased the salon which she would repay in 2 years time using the salon income and the salary she got from the bank.

Two months later after the purchase the bank went bust and employees were sent packing. Although she was retained to help collect the banks’s outstanding debt she couldn’t pay the money she borrowed for her salon and she also had a house mortgage.

She decided to sell her salon to pay off more debts and moved to a better location in Nairobi where she started Ashleys beauty salon. She recalls when setting up her first outlet she ran out of money and even had to sell her car to complete the project. She opened Ashleys
